Terms of Service for HomePays

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of the HomePays mobile application (the "App"), operated by M&H Home Solutions LLC ("we," "our," or "us"). By creating an account or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

2. Eligibility

You must be at least 18 years old and able to form a binding contract to use the App. By using the App you represent that you meet these requirements.

3. Your Account

• You agree to provide accurate, current, and complete information and to keep it updated.
• You are responsible for keeping your account and sign-in codes secure and for all activity under your account.
• Notify us promptly of any unauthorized use of your account.

4. The Referral Program

• HomePays lets you refer home-improvement projects to M&H Home Solutions and earn rewards.
• Eligible referrals: a referral may qualify for a reward only if it is a new, valid lead for a genuine prospective customer and the project closes/completes, as verified by M&H Home Solutions.
• Reward amounts are shown in the App and may change at any time. The amount that applies is the one confirmed by us for the closed project.
• Payment: rewards are paid through your selected payout method after the project closes and any required tax documentation (e.g., a W-9) is on file. You are solely responsible for any taxes owed on rewards.
• No guarantee: submitting a referral does not guarantee a reward. We may decline, adjust, or withhold rewards for referrals that are duplicate, self-referrals, fraudulent, inaccurate, or that otherwise do not meet program requirements.
• We may modify, suspend, or discontinue the referral program or its reward structure at any time.

5. Customer Information & Consent

When you submit a referral that includes another person's contact information, you represent that you have that person's permission to share their information with us for the purpose of being contacted about a home-improvement project. Do not submit information you are not authorized to share.

6. Acceptable Use

You agree not to:

• Submit false, misleading, duplicate, or fraudulent referrals or information.
• Send unsolicited or spam communications, or impersonate any person or entity.
• Use the App for any unlawful purpose or in violation of these Terms or applicable law.
• Interfere with, disrupt, or attempt to gain unauthorized access to the App or its systems.

7. Intellectual Property

The App and its content, logos, and trademarks are owned by or licensed to M&H Home Solutions LLC and are protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for its intended purpose. You may not copy, modify, distribute, or reverse-engineer the App.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or secure.

9. Limitation of Liability

To the maximum extent permitted by law, M&H Home Solutions LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the App. Our total liability for any claim relating to the App will not exceed the total rewards paid to you in the twelve (12) months before the claim.

10. Indemnification

You agree to indemnify and hold harmless M&H Home Solutions LLC from any claims, damages, or expenses arising from your use of the App, your referrals, or your violation of these Terms or any law or third-party right.

11. Termination

You may stop using the App and delete your account at any time from Profile → Delete Account. We may suspend or terminate your access if you violate these Terms or engage in fraud or abuse. Pending rewards may be forfeited in cases of fraud or program abuse.

12. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute will be resolved in the state or federal courts located in Miami-Dade County, Florida.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms here and update the "Last Updated" date. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.
